1. How can SHIELD arrest someone for voilating a law that's not a law yet? (Referring to SHIELD agents trying to arrest Cap.)

Being a member of the US military means they can lock your ass up if you refuse orders from a superior officer. Hell, the real-life US military is currently throwing the book at a lieutenant who deliberately missed his deployment to Iraq.
