There's been a lot more activity in the gallery lately. Really great to see Vincent, TartanNinja, DarqueImages, OCP, B and all the others we hadn't seen much of lately posting again. Since there was a decent turnout on that last one, I figure why not strike while the iron is hot and things are active? ...so I'll toss out another challenge:
Cover Flip
Take an existing comic, magazine or book cover and alter it to change it's context. It can be as simple as rewriting some word balloons or as complex as adding, removing and changing figures, costumes, expression, logo, whatever... just turn it into something other than it's original intent and lastly, have fun.

There was a pretty decent turn out for the influence maps challenge but I'd like to see more folks jump into the mix! C'mon you guys! This is designed to be another easy and fun one.

Man these are flying in so fast, I can hardly keep up!

I'm really happy to see chillyplasma joining in the fun. Man, talk about stepping up... first to submit 3 in one day for this challenge... all really funny stuff too!

Newcomer JMonteiro has got to be the quickest to respond to a challenge... heck, he answered the first before I could ask and this one before I could blink!

I'm pretty sure that when it started it was supposed to be flipping titles that actually existed.. i.e. taking ghostrider's Johnny Blaze and putting him in a wetern comic. However, I think at some point the Challenge got a lot more interesting and hilarious when new titles were applied to pre-existing comics.. i.e. my "50 Shades".

We see to have just taken it and ran with it, with monstrously hilarious results...

DarqueImages is right. The idea is to change the context of something that already exist so sorry, it's got to be a real mag however there are a number of fun and funny made-up mag covers in the gallery and I'm sure yours would make a fine addition so I encourage you to run with the idea and do it! Then when you're done with that, find a cover to alter and join in the fun!

So okay.. I've recently caught a little grief from a fellow Heromorpher about my first Playboy cover and the art I used. Apparently, it's a violation of posting policy here on HM to use someone's work without permission? Uhm... isn't that on a technicality, what we've been doing with these flips? I'm pretty sure not a single one of us has gotten permission from DC, Marvel, Darkhorse or any other company to use their covers.
Furthermore, how many of us have done a manip using a actor or actress, models and porn stars as our various bases? Pretty sure none of us contacted any of them to get permission to use their image.

I do believe that if it's on the internet and it doesn't say you can't use it... then you can use it. Am I wrong?

It's called "Common License" and as long as I'm not using the image to turn profit, I'm free to use it. Correct?

I don't appreciate being put under fire like that. I know the approach that this person took was civil but there is another way to approach that. Just sayin'.

Er... Yeah, this whole website is kinda built on copyright infringement. Literally. IIRC 'heromorph' originally referred specifically to photomanips, and those by definition involve using other people's (usually) copyrighted photographs. Cover flips are in the same boat. I always assumed that ethically speaking, we claim them as our own work because of the effort we put into altering them. That and their being not-for-profit means they imo fall under fair use/fair dealing as a legitimate exception to copyright law. I absolutely think posting other people's art or photography unaltered and without permission in the main gallery (the cookie jar is different, since it's a resource) is bad form and shouldn't be allowed. But I don't see how using fan art or manips in an image is different from using photos or professional comics artwork IF the final product is substantially your own work.

That's my completely amateur and ill-informed opinion, anyway.

Thank you B for that eloquent answer to DarqueImages' question. I certainly couldn't have said it better. Indeed, Fair Usage is the correct term and is acceptable. BTW, anyone who knows B would know his opinion is anything but "completely amateur and ill-informed"

OK, as it was me who made the comment I am going to clear this thing up. Everyone else is muddling the argument.

First off ? the law.
Yes Heromorph is full of Trademark infringement. Batman is a Trademark, if you draw a picture of Batman and post it to the internet you are violating Trademark law. It does not matter if it is ?not for profit? or you sell it, it is still a violation. These cover-flips are a copyright violation, copyright means the specific work (in this case a comic cover). Reposting and changing the cover without permission is a violation, again doesn?t matter if money is involved.
Fair use is like when you buy a CD and copy it to tape for your own use in your car. Fair dealing is when you buy something, e.g. a comic for personal use, and are allowed to sell it.
So how does anyone get away with it? The internet is too big and it is too much trouble to track down people and take them to court, though it has been done.

You are wrong. That?s like saying if your neighbour leaves his car running and doesn?t say you can?t take it, that you can take it. Or that you can legally download a pirated movie ? you can?t (not legally).

Wrong again. Something has a Creative Commons License only if the creator has chosen to apply it. In this case the Ms Marvel could not have such a license as you need to own any relevant Trademarks first.

That is how it works, in simple terms. And I in no way deny that people on this website have breached these laws. THAT IS COMPLETELY BESIDE THE POINT.

The Heromorph Rules.
A line was drawn saying you can?t use another artist?s work without permission. If you can?t get permission, you don?t use it. Simple, that?s the rule, it?s reminded every time you upload an image. The Heromorph rule has nothing to do with the law.
It means I can?t take one of B?s images and one of DarqueImages? images and turn it into a crappy cut and paste MS paint suck-fest. If I want to do that image I would have to make it myself. Same as you could have made your own Ms Marvel (the point was to get people to create for themselves).

B does have a important point to make ?IF the final product is substantially your own work.?
It?s not. You added some text. Take away Ms Marvel and there is nothing of interest there.

Regardless I don?t intend to visit this website ever again. Recently something happened here that I found to be deeply offensive, I won?t go into details. Add to that the above argument that it?s OK to rip off other artists and Heromorph is no longer a special place.
